Terms of Service

You must be at least 18 and using the app for a business — as a carrier, owner-operator or broker, or on behalf of one. You are responsible for the accuracy of the company, MC, DOT and contact details you enter, and for keeping your login secure. Activity under your account is your responsibility.

Access is a flat monthly subscription, charged in advance through Base44 Payments. Your subscription renews each month until you cancel. You can cancel at any time from the billing page; access continues through the period you already paid for and then stops, with no charge for a partial month. Failed payments may suspend access until the balance is settled. If you believe you were charged in error, tell us through the contact page and we will look at the payment records for your account.

The app builds load agreements from the terms you enter and lets both sides sign them electronically from a link. Signing records the typed name, drawn signature and timestamp for each side. An agreement is between you and the broker — Hotshot PayGuard is not a party to it, does not guarantee that a broker will pay, and does not provide legal advice. Electronic signatures are intended to be valid under the federal ESIGN Act and state UETA laws, but you are responsible for confirming an agreement suits your load before you send it.

Broker risk scores, summaries and reports are built from what drivers submit. They are other drivers' accounts of their own experience, not our findings of fact, and we do not verify every claim. File reports only about brokers you actually worked with, and describe what happened accurately and without abusive language. You are responsible for what you submit. Reports that are knowingly false, or that harass or defame, may be removed and can end your access. Reports are visible to other signed-in drivers as described in the Privacy Policy.

A broker account may post loads to driver boards. Broker-posted loads must be real, currently available freight offered on the terms shown. We may review, pause or remove a broker account or post that appears inaccurate, and a public board link can be paused or closed by the account that created it. Driver claims on a public board are passed to the board owner; the app does not broker, book or move freight and is not a party to any arrangement made from a board.

You keep ownership of the documents, notes and information you upload. You give us permission to store, process and display it only to run the app for you and, where you post publicly or share a link, to deliver it to the people you shared it with. Do not upload anything you do not have the right to store.

Do not use the app to break the law, to impersonate another carrier or broker, to sign an agreement as someone else, to upload malware, to scrape or resell other users' data, or to attempt to reach records that are not yours. Do not use it to send demands or notices that are false or unlawful.

The app is provided as it is. We work to keep it running and accurate, but we do not promise uninterrupted service, and features may change. To the extent the law allows, we are not liable for lost freight opportunities, unpaid invoices, lost profits or indirect damages arising from use of the app, and our total liability is limited to the subscription you paid in the three months before the claim. Nothing here limits rights you have that cannot be waived.

You may stop using the app at any time and cancel your subscription. We may suspend or end access if these terms are broken, if a payment fails, or if an account is used to harm other users. On request we will delete your account and its records, as described in the privacy policy.
